When Your Life Changes, Divorce Orders Can be Changed

Life goes on after your divorce and many changes can occur in your life. Jobs can come and go — and with them your ability to pay child support. A workable child custody arrangement can become unworkable due to problems at school or at home. When your life changes, child custody and support orders can be changed as well. In some cases, even community property settlements can be altered.

I'm Ryan Beason, a family law attorney in League City, Texas. Modifications to divorce orders can be more highly contested than the original divorce, especially in cases of child removal by a primary conservator or a change in child custody.

Modifications to Child Custody

Child custody can be changed if there has been a change in circumstances affecting the best interests of the child, such as:

  • Problems at school
  • Problems with the child at home
  • An older child's custody preference
  • Changes in the home environment
  • Behavior of a parent, such as primary conservator disparaging the other parent in front of the child
  • Relocation of a primary conservator

Texas judges generally don't like to see parents request a change in child custody within three years of the divorce decree.

Modifications to Child Support

In this economy, many unemployed or underemployed parents can't afford the child support payments they used to make. If your income has decreased or increased, your child support payments may be changed accordingly.

Modifications to Community Property Division

While changes to community property settlement are rarely granted after divorce, judges will approve a change if one side hid or mis-characterized assets during the divorce.
